GENERAL CONDITIONS OF SALE
Preamble
These general terms and conditions, which are governed by the Consumer Code (Legislative Decree No. 206/2005), Section II Distance Contracts (Articles 50–67), by the regulations on electronic commerce (Legislative Decree No. 70/2003), and by Directive 2011/83/EU on consumer rights, must be understood as an essential and integral part of every supply by Ikiya S.r.l.s. (hereinafter also referred to as "Company"), even when not referenced in individual orders and until expressly waived, and supersede any conditions set by the purchaser (hereinafter also referred to as "Customer"). These conditions may not be modified nor waived except with the express written approval of the Company.
1. Identification of the seller

2. Subject of the supply
2.1 The supply will include all products expressly selected by the Customer from the online catalog and faithfully listed in the electronic order;
2.2 Products available for online purchase include Japanese food items, traditional clothing, decorative items, and accessories; Products are intended for sale in Italy and Europe; all Products are subject to current availability. Ikiya S.r.l.s. reserves the right to vary the limits on quantities and/or types of goods purchasable online on the Site. The Customer will be informed if their order cannot be fulfilled due to unavailability of the ordered product.
3. Order procedure and contract conclusion
3.1 To place an order, the Customer must complete the electronic purchase procedure on the website www.ikiya.it, following the instructions provided. The Customer must add the product to the "cart" area and, after reviewing and accepting the delivery and packaging costs as well as these General Conditions and the conditions on the right of withdrawal, must select the desired payment method and choose the "complete order" option.
3.2 Before completing the purchase, the Customer declares that they have received information on the right of withdrawal, on the methods and timeframes for returning purchased Products, in accordance with Articles 49 and 52 et seq. of Legislative Decree 206/2005 ("Consumer Code").
3.3 The contract is finalized when the Customer completes the guided purchase procedure on the website www.ikiya.it and upon receipt of payment, according to the different characteristics provided by the activated payment methods.
3.4 By submitting the order to Ikiya S.r.l.s., the Customer acknowledges and declares that they have reviewed all information provided during the purchase procedure and fully accept these General Conditions of Sale.
4. Sale price
4.1 Product prices are defined in the Ikiya S.r.l.s. online catalog and are inclusive of VAT for orders destined for Italy. For orders destined outside Italy (EU countries), prices are not subject to VAT, in accordance with European regulations on distance selling. In both cases, shipping and packaging costs are excluded.
4.2 Unless otherwise agreed in writing, all transportation, packaging, and insurance costs will be borne by the Customer as indicated in the guided procedure on the website;
5. Payment methods
5.1 Ikiya allows the Customer to pay for products and related shipping costs via bank transfer or through PayPal, Stripe, and Klarna:
– CREDIT CARD PAYMENTS VIA STRIPE:
Ikiya allows payment by credit or debit card through the Stripe network. Payment is secure and encrypted according to PCI DSS security standards. The Customer must enter their card details directly on the Stripe platform, without Ikiya having access to sensitive information.
– INSTALLMENT PAYMENTS VIA KLARNA:
Ikiya allows installment payments through Klarna. The service is subject to Klarna's approval and its general terms and conditions. The Customer can choose the installment plan directly during the checkout procedure.
– PAYMENTS VIA PAYPAL:
Payments sent via PayPal will be processed through a personal PayPal account.

As the reference, enter your first and last name as shown in your registration on the Ikiya.it website.
According to current banking practice, the transferred amount is credited to the beneficiary's account no earlier than 3/4 business days from the date of transfer. From the moment the order is placed on Ikiya.it, the selected goods are reserved by the customer until receipt of the bank transfer by Ikiya.it. If payment is not received within 5/6 days of placing the order, the order will be automatically canceled. Shipment of goods will occur upon receipt of the bank transfer.
6. Transportation, delivery, and shipping costs
Important note: couriers do not collect or deliver on weekends and public holidays, and Ikiya is closed on Mondays. Please keep this in mind when placing your order.
6.1 In the absence of specific instructions, Products purchased on the Site will be delivered to the address resulting from the details provided during registration;
6.2 Ikiya will issue an electronic invoice for shipped goods only if expressly requested by the customer, who must provide complete details (company name, VAT number and/or tax code, unique code). No changes to the invoice will be possible after its issuance.
For orders placed by private individuals without a VAT number, orders will be shipped with a fiscal receipt.
6.3 Delivery costs are borne by the Customer and are clearly indicated in the order form. Unless otherwise expressly stated, shipping costs for Italy will be calculated based on the destination location and shipping method. With a minimum order of €85.00, shipping is free throughout Italy (except for islands and remote areas). Remote areas apply only to Italian territory. For EU countries, shipping costs vary based on destination and are indicated when selecting the country in the shipping address.
6.4 When placing the order, the customer can select the type of shipping that best suits their needs:
– Express courier €9.00
Delivery will be made via express courier. We do our best to prepare and ship all orders received and paid by 12:00 PM; after that time, they will be processed the next business day. The above specification is valid only for products available in stock; in case of purchasing products with a longer shipping timeframe (indicated on each product page), order processing will occur when all purchased items are available at our headquarters.
– Remote areas – €24.00
Delivery to remote areas requires a surcharge and cannot benefit from free shipping.
– Pickup in Treviso (selectable only for customers residing in Veneto)
You can pick up the package directly at our headquarters at no shipping cost: Via San Nicolò 15, 31100 Treviso. Goods can be collected during regular store opening hours.
Goods are ready from the same day as the order and must be collected within five (5) business days from the date of online reservation.
– Free shipping
With a minimum order of €85.00, you get free shipping.
Free shipping to the islands (Sicily and Sardinia) applies with a minimum order of €100.00.
– Shipping costs to European Union countries
Shipping costs vary based on the destination country. You can check the cost when entering the country in the shipping address.
Pickup by courier within 48 hours of the order (except for orders placed from Friday to Sunday and on public holidays). Delivery varies depending on the country.
We currently ship to: Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Estonia, Finland, France, Germany, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania, Slovakia, Spain, Sweden, Hungary.
6.5 The customer must provide a shipping address, ensuring that someone is present to receive the package; standard shipping does not allow for a specific delivery time, and the courier does not deliver to upper floors. In case of failed delivery due to the recipient's absence or incorrect or incomplete address, the costs for releasing the product from storage will be borne by the customer and paid directly to the Express Courier representative at the time of delivery.
6.6 All purchases will be delivered to the Customer via courier. Orders will be processed and delivered from Tuesday to Friday, excluding public holidays and national holidays. Ikiya is not responsible for unforeseeable delays, provided that, except in cases of force majeure, Products will be delivered within a maximum of 30 (thirty) days from the day following the one on which the Customer transmitted the order to Ikiya.
If delivery does not occur within 30 days, the Customer may invite Ikiya to make the delivery within an appropriate additional period. If this period expires without result, the Customer will have the right to terminate the contract and obtain a full refund of the amounts paid.
6.7 For delivery of goods, the presence of the Customer or their representative at the recipient's address indicated in the order is required. At the time of delivery by the Courier, the Customer must verify that the number of packages delivered corresponds to what is indicated in the transport document (DDT);
6.8 It is the customer's responsibility to check the condition of the delivered Product. If the package shows signs of breakage, dents, tampering, and/or alteration, the Customer is invited to accept the package from the courier with "Reserve for Inspection." If damaged goods are found inside, please promptly notify Ikiya by email at: [email protected].
The communication must list the damaged Products, attach the courier's delivery slip with the notation "Accepted with reserve for inspection" and, where possible, attach photographic evidence of the damaged Product. If the package is accepted without "Reserve for inspection," we will not be able to proceed against the courier in any way and therefore cannot resend the damaged goods.
6.9 If Ikiya is unable to deliver the ordered goods due to unavailability, even temporary, of the Products, it will promptly notify the Customer, and in any case no later than 30 (thirty) days, via email. The amount already paid by the Customer will be refunded as soon as possible.
6.10 As soon as Ikiya delivers the goods to the Courier, the Customer will receive a confirmation email of the shipment.
7. Right of withdrawal, exchange of goods, and disputes
7.1 Right of withdrawal
Pursuant to Articles 52 et seq. of Legislative Decree 206/2005 ("Consumer Code"), the Customer has the right to withdraw from the contract within 14 days of receiving the Products, without having to provide any reason. The right of withdrawal applies to consumers residing in Italy and Europe, in accordance with Directive 2011/83/EU.
7.2 How to exercise the right
To exercise the right of withdrawal, the Customer must send a written communication, preferably via email to [email protected], expressly stating the intention to withdraw from the contract. 7.3 Effects of withdrawal
In case of withdrawal, Ikiya will refund to the Customer all payments received, including standard delivery costs (excluding additional costs resulting from the choice of a type of delivery other than the least expensive standard delivery), without undue delay and in any case within 14 days of receiving the withdrawal notice. The refund will be made using the same payment method used by the Customer, unless otherwise agreed.
7.4 Return of Products
The Customer must return the Products intact and adequately packaged, without undue delay and in any case within 14 days from the date on which they communicated the withdrawal. The direct costs of return are borne by the Customer.
7.5 Exceptions to the right of withdrawal
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for:
– the supply of goods that risk deteriorating or expiring rapidly (e.g., perishable food products);
– the supply of goods made to measure or clearly personalized.
8. Limitation of liability and warranties
8.1 Except in cases of willful misconduct or gross negligence, Ikiya will not be liable to the Customer in any capacity as a result of:
– damage or loss caused by the products (or their use) by the Customer;
– damage not caused by Ikiya's breach.
8.2 Within the limits specified above, Ikiya's liability may not in any case exceed the price paid by the Customer for the product that caused the damage.
8.3 Ikiya markets high-quality products, for which any warranty provided by law is directly provided by the manufacturers, and the reference regulations as well as the methods of applying the warranty will be those indicated and highlighted by the manufacturer together with the product.
8.4 The legal warranty of conformity provided by Articles 128 et seq. of the Consumer Code applies to products purchased by consumer Customers.
9. Provisions on Privacy and personal data protection
9.1 When a new Customer places an order through the website www.ikiya.it, their data is entered into a database that will be constantly updated, which will allow us to better meet the needs of Customers themselves in the future.
9.2 The collection and processing of personal data are carried out in accordance with the provisions contained in EU Regulation 2016/679 (GDPR). The Customer has in any case the right to obtain confirmation of the existence of personal data concerning them, even if not yet registered, and their communication in intelligible form. The Customer has the right to obtain access, rectification, erasure ("right to be forgotten"), restriction of processing, data portability, and to object to processing pursuant to Articles 15-22 of GDPR 679/2016.
9.3 These rights may be exercised by written communication to be sent to Ikiya S.r.l.s. at the email address [email protected] or through the contact details indicated in the Privacy Policy available on the website www.ikiya.it.
10. Jurisdiction
10.1 The conditions of access to the Site are governed by Italian law and must be interpreted in accordance with Italian laws.
10.2 For disputes with consumers residing in Italy, the Court of Treviso will have jurisdiction. For disputes with consumers residing in the European Union, the court of the consumer's residence or domicile will have jurisdiction, pursuant to Article 66-bis of the Consumer Code and Directive 2011/83/EU.
